On June 6-7, 2013, the symposium on international private law in China and Europe which was host by Max-Planck Institute for comparative and international private law (Hamburg) was held in Hamburg. More than 60 private international law scholars and practitioners from China, Germany, France, Britain, Italy, Spain, Poland, the Netherlands, Denmark, Switzerland and other countries and regions, attended the meeting. This symposium concerned the development of legislation, practice, and theory of private international law in China and Europe, and paid particular attention to the issue on jurisdiction, choice of law, enforcement, arbitration in the process of trade between China and Europe, especially on the explanation and application of Law of the Application of Law for Foreign-related Civil Relations of the People’s Republic of China and its judicial interpretation.
At the invitation of Jürgen Basedow, the president of Max-Planck institute for comparative and international private law, Huang Jin, the president of China society of private international law also the president of China university of political science and law, lead the delegation of China society of private international law (8 people) to the meeting. Professor Huang Jin delivered an English speech entitled “New Perspectives of Private International Law in China” on the first seminar about latest development of recognition and enforcement of jurisdiction, choice of law, and foreign judgment. Professor Huang’s speech introduced the history of private international law and two types of source of law in China, domestic law including statute and judicial interpretation and international law including treaty and international custom, discussed the development of Chinese legislation in private international law including the 4 features and 8 innovations of Law of the Application of Law for Foreign-related Civil Relations of the People’s Republic of China, the rules of foreign civil procedure in the amendments of the civil procedure law in 1991, 2007 and 2012 and the main content of judicial interpretation of Law of the Application of Law for Foreign-related Civil Relations of the People’s Republic of China. This speech aroused European attendees’ great interest in Chinese private international law.
In the following two days, Professors from China delivered following speeches in corresponding seminar, “Selected Problems of General Provisions in PIL: the PRC Perspective” delivered by professor Chen Weizuo at Tsinghua university, “The Choice of Law for Property Rights in China: Progress and Imperfection” delivered by associate professor Du Huanfang at Renmin university of China,“Contract Reforms in China’s Private International Law” delivered by professor He Qisheng at Wuhan university,“The Latest Developments in China’s Conflicts Law of Non-contractual Obligation” delivered by associate professor Zou Guoyong at Wuhan university, “Personal Status in Chinese Private International Law Reform” delivered by Professor Guo Yujun at Wuhan university, “The New Chinese Conflict-of-law Rules for Corporate Governance Is the Middle Way Feasible?” delivered by professor Du Tao at Fudan university, “China – A Developing Country in the Field of International Arbitration: An Outline” delivered by Professor Lu Song at China Foreign Affairs University, and exchanged the view of jurisprudence and application of Law of the Application of Law for Foreign-related Civil Relations of the People’s Republic of China and its judicial interpretation with attendees.
This symposium which is an important international academic conference after 2011 private international law globe forum in Beijing, 2011 symposium on private international law in East Asia（China, Japan, South Korea）in Tokyo,2011 symposium on private international law in China and South Korea in Seoul,2012 symposium on private international law in China and South Korea in Beijing improve the globe influence of China Society of Private International Law.
